David’s practice is primarily focused on employee benefits, ERISA, and executive compensation.

He represents clients with a wide range of benefits issues, including establishment, termination, and revision of various types of executive compensation, particularly those involving Code section 409A, such as nonqualified deferred compensation plans, equity compensation plans, and employment agreements.

He also advises companies on compensation and benefits issues during mergers and acquisitions, including 401(k) plans, pension plans, medical plans (including reporting issues involves Forms W-2, 1094, and 1095), the self-correction programs for qualified and nonqualified retirement plans, cafeteria plans, welfare plans, and 409A issues that affect employment agreements, severance benefits, and other executive compensation.

David has advised clients including Fortune 500 companies, as well as smaller companies, not-for-profit organizations, and churches.

Since 1997, David has maintained an AV Preeminent® Rating (highest possible rating) in the Martindale Hubbell Legal Directory based on peer review by lawyers and judges. He has been a member of the Pro Bono College of the State Bar of Texas since 2002, an honor reserved for members of the Texas Bar who demonstrate a substantial annual commitment to pro bono legal services.
